Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and thebestpornai ("we," "us," "the Service") governing your access to and use of thebestpornai.com and any related applications (collectively, the "Site"). By accessing, browsing, registering for, or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Eligibility & Age Verification

5. User-Generated & Creator-Uploaded Content

Any content submitted, uploaded, or published by a Creator or user ("User Content") is the sole responsibility of the person who submitted it. By submitting User Content, the submitting party represents, warrants, and agrees, irrevocably and without limitation, that:

• They own all necessary rights to the content, or have obtained all necessary licenses, consents, and releases to submit it and to grant the rights described in these Terms;
• Every person depicted in the content who appears to be a human being was, at the time the content was created, an actual person who was at least 18 years of age, and they possess or have access to records substantiating this as required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75, where applicable;
• Every person depicted consented to being filmed, photographed, or otherwise depicted, and to the distribution of that depiction on the Site;
• Where the content is AI-generated or synthetic, it does not depict, simulate, or evoke any real, identifiable minor, and does not use the likeness of any real, identifiable adult without that person's consent;
• The content does not infringe the intellectual property, privacy, publicity, or other rights of any third party;
• The content complies with these Terms, including the prohibitions in Section 6, and with all applicable law.

The submitting party remains solely and fully responsible for their User Content and for any consequences of submitting it. We do not pre-screen all User Content and do not endorse any User Content by hosting it. Submitting User Content grants us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and transmit that content solely in connection with operating and promoting the Site.

6. Prohibited Content & Conduct

The following are strictly prohibited on the Site, with zero tolerance and no exceptions. Content of these categories will be removed on discovery and may be reported to relevant authorities and organizations, including the National Center for Missing & Exploited Children (NCMEC) where legally required or appropriate:

• Any depiction, whether real, AI-generated, drawn, or otherwise simulated, of a minor (any person under 18, or appearing or purporting to be under 18) in a sexual context, including content described using "teen," "school," "student," "young," or similar age-minimizing framing applied to sexual content;
• Content depicting non-consensual sexual acts, or content the uploader knows or should know was produced or shared without the consent of a depicted, identifiable real person;
• Content depicting an identifiable real person without that person's consent, including non-consensual "deepfake" or synthetic content using a real person's likeness;
• Content involving human trafficking, coercion, or exploitation of any kind;
• Bestiality, necrophilia, or content otherwise obscene under applicable law;
• Content that infringes any third party's copyright, trademark, or other intellectual property or publicity rights;
• Malware, spam, or attempts to circumvent Site security or moderation;
• Any other content or conduct that violates applicable law.

If you become aware of content on the Site that you believe violates this Section, report it immediately using the on-page reporting tool or by contacting contact@thebestpornai.com.

7. Content Moderation & Removal

We reserve the right, but do not undertake the obligation, to review, monitor, remove, or restrict access to any User Content or account at any time, with or without notice, for any reason or no reason, including suspected violation of these Terms. Removal decisions are made at our sole discretion and are final.

8. Intellectual Property

The Site's design, software, trademarks, and any content we directly produce are owned by us or our licensors and protected by applicable intellectual property law. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY USER CONTENT IS ACCURATE, LAWFUL, OR NON-INFRINGING. WE DO NOT ENDORSE AND ARE NOT RESPONSIBLE FOR ANY USER CONTENT.

12. Limitation of Liability

You agree to defend, indemnify, and hold harmless thebestpornai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Site; (b) any User Content you submit, including any claim that such content infringes a third party's rights or violates any law; (c) your violation of these Terms; or (d) your violation of any third-party right, including intellectual property, privacy, or publicity rights. This obligation survives termination of your use of the Site.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice. Sections of these Terms that by their nature should survive termination (including Sections 5, 6, 11, 12, and 13) will survive.

15. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which the Site operator is established, without regard to conflict-of-law principles, except where mandatory local consumer-protection law provides otherwise. Any dispute arising out of these Terms or the Site will be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction there.
