This policy has not been reviewed by an attorney, and — critically — DMCA safe-harbor protection under 17 U.S.C. § 512 requires actually registering a designated agent with the U.S. Copyright Office (via the Copyright Office's online Designated Agent Directory) in addition to publishing a policy like this one. Until that registration is completed, this page alone does not secure safe-harbor protection. 1. Our Approach to Copyright

thebestpornai respects the intellectual property rights of others and expects users and Creators to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

2. How to Submit a Takedown Notice

If you believe content on the Site infringes your copyright, send a written notice to our designated agent (contact details in Section 6) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

• A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
• Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works on the Site are covered by a single notice);
• Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it (e.g. the exact URL on thebestpornai.com);
• Your name, address, telephone number, and email address;
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices that do not substantially comply with these requirements may not receive a response.

3. Our Response

On receipt of a valid notice, we will act expeditiously to remove or disable access to the identified material, and will make a good-faith attempt to notify the user or Creator who submitted it. Repeat infringers are subject to termination of their account and removal of all their content, in accordance with our repeat-infringer policy (Section 5).

4. Counter-Notification

If you are the user or Creator who submitted material that was removed or disabled, and you believe it was removed as a result of mistake or misidentification, you may submit a counter-notice to our designated agent that includes:

• Your physical or electronic signature;
• Identification of the material that was removed and its location on the Site before removal;
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which thebestpornai may be found), and that you will accept service of process from the person who submitted the original takedown notice.

On receipt of a valid counter-notice, we will forward it to the original complaining party. If that party does not notify us within 10 business days that they have filed a court action seeking to restrain the user from engaging in infringing activity, we may reinstate the removed material, as required by 17 U.S.C. § 512(g).

5. Repeat Infringer Policy

We terminate, in appropriate circumstances and at our discretion, the accounts of users or Creators who are determined to be repeat infringers.

6. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages, including costs and attorneys' fees.
