1. Nature of the Site's Content

The visual content available on the Site consists of: (a) content that is entirely AI-generated and does not depict any real person, and (b) content submitted by independent third-party Creators and users under the representations described below. thebestpornai does not itself film, photograph, or otherwise directly produce sexually explicit visual depictions of real persons.
2. AI-Generated Content
Where content is labeled or reasonably understood to be AI-generated, it does not depict an actual, real person and therefore does not depict a "performer" within the meaning of 18 U.S.C. § 2257. Our Terms of Service separately and absolutely prohibit AI-generated content that depicts, simulates, or evokes a real, identifiable minor, or that uses the likeness of a real, identifiable adult without that person's consent, regardless of whether § 2257 applies to that content as a technical matter.
3. Creator- and User-Submitted Content
For content submitted by a Creator or user that depicts what appears to be a real person, thebestpornai relies on the mandatory representations made by the submitting party at the point of upload, as set out in our Terms of Service. Every submitting party represents and warrants, as a condition of using the upload feature, that:
- Every person appearing in the submitted content was an actual adult, at least 18 years of age, at the time the content was created;
- The submitting party is either the original producer of the content and personally holds the records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for that content, or has obtained those records, or obtained a compliant chain-of-custody representation, from the original producer; and
- The submitting party will produce those records to thebestpornai or to a requesting authority promptly upon lawful request.
Content is removed immediately upon any credible indication that these representations are false, and the associated account is subject to suspension and referral to law enforcement or the National Center for Missing & Exploited Children (NCMEC) where applicable. Nothing in this Section relieves any original producer of content of that producer's own independent, primary obligations under 18 U.S.C. § 2257.
